PHYSICAL, MENTAL, AND EMOTIONAL FITNESS FOR INTERACTION WITH HORSES & POLICY
Our services involve direct interaction with horses. For safety reasons, all participants must be physically, mentally, and emotionally capable of taking part in group activities and handling horses. If Partridge Horse Hill (PHH) determines that you or your child is compromising the safety or experience of the horses, staff, farm, or other participants, we reserve the right to discontinue services. In such cases, no refund will be provided. If you or your child has any concerns please contact us prior to registration to determine if our facility and programs are a suitable fit.

MEDIA USE, PRIVACY, AND DEFAMATION POLICY
Media Consent:
Participants (and parents/legal guardians for minors) acknowledge that photographs or videos of participants, their horses, or visitors may be taken during activities at PHH, Harmony Horsemanship (HH), Lindsey Partridge (LP), Natural Horsemanship Association (NHA), or during offsite events. These images or videos may be used for promotional, educational, or social media purposes. PHH/HH/LP/NHA may be compensated for this media. Participants and their guardians will not receive any compensation for the use of such media. Consent is implied by participation, and there is no time limit on the use of these images or videos. Participants who do not wish to be included in media must inform the person capturing the media and remove themselves from group photos or videos.

Prohibition of Negative Public Discussion and Defamation:
Participants, and their guests or visitors, agree not to engage in negative public discussions (in person or on social media) about PHH, HH, LP, NHA, its staff, or other participants. Any concerns or disputes should be raised directly with management and, if necessary, escalated to the appropriate legal authorities. Negative comments or media intended to harm the reputation of PHH, HH, LP, NHA, its staff, or boarders are strictly prohibited.

Financial Liability for Defamation or Negative Media:
Should a participant or their guest violate this policy by engaging in defamation or unauthorized sharing of negative media, they agree to be financially liable for any resulting damages. For example, if two individuals cancel their commitment to weekly lessons or decline to sign up due to reputational harm caused by negative comments or media, the financial loss is calculated as $63.50 per lesson per person. Over the course of a year (52 weeks), this amounts to a minimum base fee of $6,604 for two individuals ($63.50 x 52 lessons x 2 persons). This base amount will be charged to reflect damages even if the full extent of client loss is not immediately clear.

Guests and Visitors:
Participants are responsible for ensuring that their guests or visitors comply with these terms. Any violation by a guest or visitor will be considered a breach by the participant, who will be held responsible for any resulting damages or actions.

LIABILITY WAIVER, TERMS & POLICY
Every participant must read and understand this waiver before engaging in equine activities.

TO: Lindsey Partridge, Harmony Horsemanship, Natural Horsemanship Association, Partridge Horse Hill, their directors, employees, officers, volunteers, business operators, family, and site property owners (collectively the "HOST").

Inherent Risks:
I acknowledge that equine activities carry inherent risks, including injury or harm caused by horses' unpredictable behavior. Risks include but are not limited to:

A horse's tendency to behave in ways that may cause injury, harm, or death to people or other animals.
The unpredictability of a horse's reactions to stimuli, including sounds, sudden movements, or unfamiliar objects.
Potential negligent behavior by other participants that could contribute to injury or harm.
Assumption of Risk:
I freely accept and fully assume all risks related to my or my child’s participation in equine activities at PHH.

Waiver and Release of Liability:
In consideration of my child’s participation in equine activities, I and my legal representatives agree to:

Waive all claims against the HOST for any loss, injury, or damages sustained during participation.
Release the HOST from liability due to any cause, including negligence.
Indemnify and hold harmless the HOST from any third-party claims resulting from my child’s participation in equine activities.
Complete our Liability Waiver prior to participation.

REFUNDS AND RESCHEDULING
Services are non-refundable but can be transferred to another individual, provided they are suitable for the service (e.g., skill level for a group lesson).

INCLEMENT WEATHER & CANCELLATION POLICY
Lessons are canceled if Durham Region north of Highway 7 cancels school buses due to inclement weather. If Kawartha Lakes buses are canceled but Durham Region buses are running, lessons will proceed. Coaches may be substituted, or sessions rescheduled if necessary.

PHH reserves the right to modify these terms, and notice of changes will be provided via email.
